Terms and Conditions of Sale for The Talaria UK

These terms and conditions set out how we sell Talaria electric bikes, road legal Sting models, batteries, chargers, controllers and parts, and what each of us agrees to when an order is placed. Nothing here removes a right the law gives you as a consumer.

Last updated 11 September 2026. These terms and conditions apply to purchases made from this website, thetalariauk.uk. They do not apply to goods bought from any other seller, marketplace listing or social media account, even where that seller stocks the same models.

Who we are and when these terms and conditions apply

These terms and conditions are issued by The Talaria UK, the operator of this website and a specialist retailer of Talaria electric bikes and parts. Our company registration and VAT details are available on request. Our correspondence address is available on request through our contact page, which is also the fastest route to a written reply about an order.

Where these terms and conditions refer to a consumer, they mean an individual buying wholly or mainly outside a trade, business or profession. Trade, hire fleet and resale customers buy on a separate basis, and several rights below, including the statutory right to cancel, do not apply to them.

How your order becomes a contract

An order placed on this website is an offer to buy on these terms and conditions, not a concluded contract. The confirmation email you receive after checkout acknowledges that we have your order. It is not acceptance of it.

Under these terms and conditions a contract comes into existence when we send you a dispatch confirmation, or, on a bike held for a booked delivery slot, when we confirm in writing that a specific machine has been allocated to you. Until then there is no contract and no obligation on either side beyond the return of any money taken, so we never hold payment for a bike we cannot supply.

Prices, payment and pricing errors

Under these terms and conditions the price you pay is the price confirmed at checkout, including VAT where it applies. Delivery charges are shown separately before you commit and vary with the size of the item and the destination. Our shipping policy explains how carriage is worked out.

Payment methods

We accept the payment methods displayed at checkout. Card payments are handled by our payment provider, and we never see or store your full card number. If you buy using finance, your credit agreement is with the lender, not with us. Our Talaria finance page explains it.

If a price is wrong

Occasionally a price is listed incorrectly, and these terms and conditions set out what happens next. Where the correct price is higher, we contact you before dispatch and you choose between confirming at that price or cancelling for a full refund. Where an error is obvious and could reasonably have been recognised as a mistake, we are not obliged to supply at the wrong price.

Availability, delivery, risk and title

All goods sold under these terms and conditions are subject to availability. If an item becomes unavailable after you order, we will tell you, offer an alternative where one exists, and refund you in full if that does not suit.

Every complete bike receives a pre delivery inspection before it leaves us. Delivery timescales are confirmed at checkout and in your dispatch confirmation, because they depend on the model, the service and the destination. Our delivery guide describes the delivery day.

Risk and ownership

Under these terms and conditions risk passes to you on delivery to the address on the order, or to anyone you authorised to receive the goods. From that moment loss or damage is your responsibility, which is why checking the crate before you sign matters. Ownership passes only once we have received payment in full, so goods that reach you before payment clears remain our property while you carry the risk.

Your right to cancel

Nothing in these terms and conditions can take this away. As a consumer buying at a distance you have a statutory right to cancel most orders within 14 days of receiving the goods, under the Consumer Contracts Regulations 2013. You do not need to give a reason, and you then have a further 14 days to send the goods back.

Two categories fall outside that right: a machine built or configured to your specification, and a vehicle already registered in your name. Our returns and refunds policy explains how both are treated, and the deduction we may make where a bike has been used beyond the handling needed to inspect it. To cancel, tell us in writing before the window closes.

When we can end the contract

These terms and conditions also allow us to cancel an order where we cannot lawfully or practically complete it. In every case we refund money paid for goods not supplied, and we give you the reason.

  • The goods are unavailable and no alternative suits
  • A payment fails, is reversed, or a finance application is declined
  • A pricing or specification error means the listing was materially wrong
  • We have reasonable grounds to suspect fraud or unauthorised use of a card
  • The delivery address cannot be served safely by the carriage required
  • Information you gave about age, licence or intended use is inaccurate
  • Our staff or a delivery crew are treated abusively

Warranty and your statutory rights

Goods bought from us are covered by our UK warranty, and the full terms sit on the warranty page rather than inside these terms and conditions, so the detail stays in one place. The warranty is a promise we give voluntarily. It sits on top of your legal rights, never in place of them. Those rights come from the Consumer Rights Act 2015, which requires goods to be of satisfactory quality, fit for purpose and as described. If they are not, you have remedies against us that no term on this page can reduce.

This is the part of our terms and conditions we most want you to read, because getting it wrong has consequences no refund can fix.

Off road models, including the MX and R variants, the off road XXX, the Komodo and the off road Dragon, are not type approved for public road use in the United Kingdom. They cannot lawfully be ridden on a road, a byway, a bridleway, a footpath, a pavement, a car park open to the public or a public park. They are for private land with the landowner’s permission, or a permitted off road venue.

Road legal models can be registered and used on the road, but registration, insurance, licensing and helmet use remain your responsibility. An L1e category Sting is a moped class vehicle limited to 45 km/h. An L3e category Sting is treated as a 125 equivalent. The guidance at GOV.UK on riding a motorcycle or moped sets out the requirements.

By placing an order you confirm that you are old enough to buy the goods, that you understand which category the machine falls into, and that you accept responsibility for using it lawfully. Fitting a non standard controller, raising pack voltage or removing a limiter takes a road legal machine outside its type approval.

Acceptable use of this website

Alongside sales, these terms and conditions govern how you use the website itself, and the text, photography, specifications and layout on this site belong to us or to our licensors and are protected by copyright. You are welcome to read, print and share pages for your own use. You may not copy our product copy or images onto another retail site, scrape the catalogue in bulk, or present our material as your own work. If you hold an account, keep your password to yourself and tell us promptly if you believe someone else has gained access.

Manufacturers revise components without notice, so a photograph may show a variant that differs in small details from current stock. Ask us to confirm anything that matters before you order.

Our liability to you

We accept responsibility for loss or damage you suffer that is a foreseeable result of our breaking these terms and conditions, or of our failing to use reasonable care and skill. Loss is foreseeable if it is obvious, or if both of us knew it might happen when the contract was made.

We do not exclude or limit our liability where the law does not permit it. That includes death or personal injury caused by our negligence, fraud, defective products under the Consumer Protection Act 1987, and your statutory rights where goods are faulty, not as described or not fit for purpose.

We are not responsible for loss that was not foreseeable, for losses arising from your failure to hold the correct licence, registration or insurance, for damage caused by modification, or for business losses such as lost profit.

Events outside our control

Under these terms and conditions neither of us is responsible for a failure to perform caused by an event genuinely outside our control: industrial action, carrier failure, severe weather, flood or fire, a power or network outage, a manufacturer supply interruption, port or customs disruption, or an act of government. If such an event affects your order we will contact you as soon as we reasonably can, and the time for performance is extended by the length of the delay. If the delay becomes substantial you may cancel the affected part of the order and receive a refund.

Governing law and disputes

These terms and conditions, and any contract formed under them, are governed by the law of England and Wales. If you live in Scotland you may bring proceedings in either the Scottish or the English courts, and if you live in Northern Ireland in either the Northern Irish or the English courts. Nothing here removes your right to rely on the mandatory consumer protections of the nation in which you live.

Before anyone reaches that stage, please talk to us. Most disputes come from an expectation that was never written down. Contact us through our contact page with your order reference and a short description of the problem. If we cannot agree an outcome, we will say plainly that we have reached the end of our complaints process.

Frequently asked questions

When exactly am I committed to the purchase?

When we send a dispatch confirmation, or when we confirm in writing that a specific machine has been allocated to your order. Under these terms and conditions the email you receive at checkout is only an acknowledgement. Until acceptance, either side can walk away and any money taken is returned in full.

Do these terms and conditions replace my consumer rights?

No, and they could not lawfully do so. The Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 give you rights a trader cannot contract out of. Where anything in these terms and conditions appears to conflict with them, the law wins. Our warranty is an additional promise, never a substitute.

What happens if the website shows the wrong price?

We contact you before dispatch. You can confirm the order at the correct price or cancel for a full refund, and we will not charge the higher figure without your agreement. If a listed price was obviously a mistake, we are not required to honour it.

Who registers and insures a road legal bike?

You do. We supply a machine capable of being registered and used on the road, but registration with the DVLA, insurance, the correct licence or CBT certificate, and helmet use are your responsibility as rider and keeper. If you are unsure which category a model falls into, ask first.

Can I buy through the site as a business?

Yes, and we welcome trade and fleet enquiries, but a business purchase is treated differently. The statutory right to cancel within 14 days applies to consumers buying at a distance, not to businesses. Tell us at enquiry stage so the correct terms and conditions apply.

Which courts deal with a dispute?

The contract is governed by the law of England and Wales. If you live in Scotland or Northern Ireland you can bring proceedings in your own nation’s courts instead, and the consumer protections of the nation where you live continue to apply in full.
